Freelance journalists and photographers urged a federal appeals court on Friday to strike down portions of California’s worker classification law that they say stifle their First Amendment free speech rights.
One of the law’s provisions classifies freelancers as employees if their submissions exceed the volume of work produced by “even a part-time existing employee,” the American Society of Journalists and Authors and the National Press Photographers Association argued on behalf of the freelancers. They contend that this and other restrictions create significant, unequal burdens that “impair freelancers’ legal right to speak and publish.”
